These Terms of Service (“Terms”) govern access to and use of EchoBrain’s website, web application, integrations, and services (collectively, the “Services”), provided by EchoBrain (“EchoBrain,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
By creating an account, installing EchoBrain, or otherwise using the Services, a Merchant confirms that they have the authority to accept these Terms on behalf of the business or organization they represent, and agrees to comply with them and with our Data Privacy Policy.
EchoBrain is a software-as-a-service (SaaS) platform that enables online shops and creators to collect verified reviews, visitor-submitted reviews, custom forms, and structured data, and to optionally process or analyze that data using automation and AI-based services.
EchoBrain may integrate with third-party platforms (for example, Fourthwall) to retrieve order and purchase data used to power certain features, including review verification.
Merchants may configure the Services to collect reviews, form submissions, and other content from end customers. Merchants are responsible for how that content is displayed, and must not use the Services to publish content that is fraudulent, deceptive, defamatory, or unlawful.
EchoBrain may moderate, suspend, or remove content that violates these Terms or that we reasonably believe exposes EchoBrain, Merchants, or end customers to legal or reputational risk.
EchoBrain’s “Verified” review status is a signal to end customers that a review has been produced through EchoBrain’s own verification mechanisms — currently, review submissions linked to a confirmed order or purchase. This status only has value, for Merchants and for the end customers who rely on it, if it accurately reflects that origin.
Accordingly, it is expressly prohibited for a Merchant, or anyone acting on a Merchant’s behalf, to assign, claim, preserve, or otherwise cause a review to display a “Verified” status that was not produced by EchoBrain’s own verification process. This prohibition is defined by outcome, not by mechanism, and includes — without limitation — the following:
A review may only display as “Verified” when that status was generated by EchoBrain based on order or purchase data EchoBrain itself has processed. Merchants may not represent, imply, or configure the Services to represent otherwise.
Violation of this section is a material breach of these Terms. EchoBrain may, without prior notice, remove the “Verified” designation from affected reviews, relabel or suspend affected content, suspend or terminate the Merchant’s account, and pursue any other remedy available under these Terms or applicable law. This standard is consistent with the review-integrity practices commonly applied across the review-platform industry.
EchoBrain and its licensors retain all right, title, and interest in and to the Services, including all software, branding, and underlying technology. Merchants retain ownership of the content they submit, and grant EchoBrain a license to host, process, and display that content as necessary to provide the Services.

Use of certain features of the Services requires a paid subscription. Fees, billing terms, and plan details are as described at the time of purchase or as otherwise communicated by EchoBrain. Fees are non-refundable except as required by law or as otherwise stated by EchoBrain.
EchoBrain may suspend or terminate a Merchant’s access to the Services, in whole or in part, for breach of these Terms — including any violation of Section 5 — or for conduct that EchoBrain reasonably believes creates risk or harm to EchoBrain, other Merchants, or end customers. Merchants may stop using the Services and close their account at any time.
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, EchoBrain will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from use of the Services.
Merchants agree to indemnify and hold EchoBrain harmless from any claims, damages, or expenses arising from their use of the Services, their content, or their violation of these Terms, including violations of Section 5.
These Terms are governed by the laws applicable in EchoBrain’s jurisdiction of incorporation, without regard to conflict-of-law principles, unless otherwise required by applicable mandatory law.
We may update these Terms from time to time. Material changes will be posted on our website and, where appropriate, notified within the app. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
